If your personal injury or medical negligence claim is successful, you will be awarded compensation. How much compensation you get will depend on:

  • the severity of your injuries
  • your rehabilitation needs
  • your care needs
  • the amount of money you’ve lost because of your injuries

How personal injury compensation is calculated

Compensation payouts are made up of two main parts - special damages and general damages.

Special damages

Special damages intend to recover the money you have lost as a direct result of your injuries. This can include:

  • medical costs
  • future medical care
  • lost earnings
  • rehabilitation aids
  • changes that need to be made to your home or vehicle
  • missed pension payments
  • out of pocket expenses
  • damaged personal items
  • travel costs
  • cancelled holidays

The amount of special damages compensation you get will depend on your individual circumstances. For example, if you can no longer work because of your injuries, your special damages will be greater than someone who is still able to work.

General damages

General damages intend to reflect the physical and emotional pain and suffering you have experienced as a direct result of your injuries, and the impact this has had on your quality of life.

Unlike special damages, your solicitor won’t be able to work out your general damages using a calculation. Instead, they must consider the severity of your injuries, which will be reviewed in one or more expert medical reports.

How much compensation you can expect

This list of compensation payouts reflects the general damages you might be able to expect if your claim is successful. These numbers do not include special damages, which means the total payout you receive could be much more.

The severity of your injuries will be determined by expert medical reports that your solicitor will request if they take on your case.

Other types of personal injury the Judicial College Guidelines cover include:

  • damage to internal organs
  • amputation
  • damage to upper body limbs, including wrists, elbows, hands and fingers
  • damage to lower body limbs, including ankles, knees, feet and toes
  • injuries affecting the senses
  • injuries involving paralysis
  • psychiatric and psychological damage
  • chronic pain
  • scarring facial injuries

Payout ranges are just a guide. It’s impossible to say how much compensation you’ll receive without detailed information about the extent of your injuries and the impact it has had on your day-to-day life.

No win no fee claims

When we take on your claim, there will be no nasty surprises. Our no win no fee agreements mean that if your claim is unsuccessful, there is no financial risk to you as all your legal fees are covered.

This is done by entering into and complying with the terms of a no win no fee agreement. We'll also ask you to take out and comply with the terms of an After The Event (ATE) insurance policy, when appropriate.
