
Obtaining Grant of Probate & Selling a Probate Property Case Study

Client Situation
Mrs B instructed Co-op Legal Services as she needed help in administering her late father’s Estate. Mrs B was named as the Executor in her father’s Will and she asked our Probate Solicitors to help her sell her father’s house so that the debts, such as the mortgage and credit cards, could be paid off.

How We Helped
We applied for the Grant of Probate which was granted. This allowed Mrs B to sell her late father’s house, she could then pay off his outstanding debts. We introduced Mrs B to Estate agents that advertised and sold her father’s house, and also introduced her to Property Lawyers whom acted on a fixed fee.
The house sale was unexpectedly complicated when a tenant of her father’s house refused to leave the house for the sale to take place. As part of the fixed fee service, our Lawyers followed legal procedures and gave legal notices to the tenant to ensure that occupier of the house left the property. This meant that the property was empty and the buyers of the property could move in and Mrs B received the proceeds of the house sale.
The Outcome
Mrs B was pleased when the property was sold and when her father’s debts were paid off. She also received the rest of the value of the house sale as part of her inheritance.
