Probate Completed in UK for Client in Australia
01 March 2017
Co-op Legal Services were instructed by Mrs F to help with the administration of her late father’s Estate. Mrs F and her sisters were named as Executors in her father’s Will and she wanted the assistance of our Probate Solicitors to deal with the Estate, particularly as Mrs F and most of the beneficiaries live in Australia.
With our Probate Complete Service we take full responsibility for getting the Grant of Probate and dealing with the Legal, Tax (excluding VAT), Property and Estate Administration affairs*.
*We can also pay all the costs of a Co-op Funeralcare funeral, providing the Estate owns sufficient assets which can be sold in due course to repay our costs.
How We Helped
Our Probate Solicitors and specialists applied for the Grant of Probate, including a claim to transfer the unused Inheritance Tax (IHT) allowance from the Estate of Mrs F’s mother, resulting in there being no Inheritance Tax bill. The Grant of Probate allowed Mrs F to sell her father’s house, and with the help of our Conveyancing services the house sale was completed in less than four months from the issue of the Grant.
As part of our Probate Complete service, we investigated and identified the valid shareholdings and unit trusts from documents provided by Mrs F who was concerned as there were numerous statements and certificates going back many years. This provided peace of mind that everything in her father’s Estate had been dealt with, without the need for the daunting process of Mrs F having to contact numerous share registrars and fund managers. We then arranged for a stockbroker to be instructed to deal with all of the shareholdings.
Throughout the Estate administration process we ensured that Mrs F was fully informed at all times, despite the time difference between the UK and Australia.
Mrs F was very pleased with how we helped her and her family through the Grant of Probate and Estate Administration process commenting, “I would like to take this opportunity to say that you have been my saviour with your prompt correspondence and professional support with our Dad’s affairs”.
