Client Situation__ __

Co-op Legal Services was instructed to administer the Estates of Mr & Mrs D who had sadly died within weeks of each other. We were instructed by their son in his capacity as Executor of their respective Estates.

We were able to take the stress away from our client by administering both Estates simultaneously.

With our Probate Complete Service we take full responsibility for getting Grant of Probate and dealing with the Legal, Tax (not VAT), Property and Estate Administration affairs*.

How We Helped

The Estates compromised of several bank accounts, pensions, a Trust fund, and a property which needed to be sold.

The couple had put some of their assets into a Discretionary Trust during their lifetime for the benefit of their family and for tax purposes. The beneficiaries of the Discretionary Trust weren’t sure how to deal with the Trust fund, so we made enquiries with the Trustees, and acted as a point of contact for queries until they were in communication with each other.

The Grant of Probate application was submitted for both Estates, inclusive of the Inheritance Tax forms. We also made arrangements to pay the Inheritance Tax that was due from the Estate funds.

Once the Grant of Probate had been obtained we drew down the Estate funds and were in a position to complete on the sale of Mr & Mrs D’s property.

The Executor was kept updated throughout the entire Probate and Estate administration process.

The Outcome

We assisted the family with selling the property and liaised with the Trustees to conclude the Trust.

The Probate and Estate administration processes were completed on both Estates within 9 months.

*We can also pay all the costs of a Co-op Funeralcare funeral, providing the Estate owns sufficient assets which can be sold in due course to repay our costs.
