Ms C of Bridgend was seriously injured in a car accident when she was just three months old. In the car accident collision her cot was upturned causing severe brain injury, adding to a serious heart condition detected when she was 4 weeks old; Ms C had stopped breathing at the scene until she was given mouth to mouth resuscitation.
Liability for the car accident was established in her favour before years of progress monitoring ensued to judge the effect on her ability/capacity to cope with everyday life, so that her long term needs could be adequately assessed and are financially catered for.
Alongside supported parents and specialist educational professionals, Personal Injury Solicitor Jonathan Morgan organised a team of highly specialist medical experts including Neurologists, Neuro-radiologists, Cardiologists, Neuropsychologists, Neuropsychiatrists, Paediatricians, Nursing Car experts, financial experts and senior and junior Barristers / Counsel, who between them agreed that Ms C had been left without the capacity to litigate or fully care for herself, a Court of Protection Deputy was arranged to take some pressure off her parents.
Outcome: £600,000 Compensation & £55,000 a Year
As a result of gaining all of the expert advice, dealing with sometimes opposing views from the Defendant’s experts, Personal Injury Solicitor Jonathan Morgan secured an Out of Court Settlement which provided a secure future and care for Ms C by way of a £600,000 compensation lump sum, plus £55,000 per year index linked for life.
This effectively allowing the purchase of a house for Ms C and her fiancé and mother and partner to live in, with the annual income to pay for all running costs and care costs for life.
