Family Law Case Study – Stepfather Gets Parental Responsibility

Client Situation

Mrs V and her husband Mr V, who was stepfather to her child, wanted our Family Law Solicitors to help them obtain a Child Arrangement Order. This Court Order would outline that Mrs V’s daughter would live with them and so that Mr V could get Parental Responsibility for his stepdaughter.

The daughter had not seen her biological father, who lives in Brazil, since she was very young and considered Mr V to be her father.

Without having Parental Responsibility, Mr V does not have the authority to deal with any school, education or medical situations. It would also be very difficult to travel abroad alone with her.

How We Helped

Our Family Law Solicitors made an application to the Court for a Child Arrangement Order under S.8 of the Children Act 1989. We did this with the consent of the biological father.

We gave Mr V legal advice about the application to make sure that he understood and consented to the application, and we satisfied the Court that he was fully informed and that he’d been served with the necessary documents.

The Outcome

The Court granted the Child Arrangement Order and Mr V got Parental Responsibility for his stepdaughter. So now, this stepfather can help his stepdaughter should any school related matters or medical issues arise.
