Client Situation

My client had applied for a new job and required legal advice on the enforceability of Restrictive Covenants in his current contract of employment.

He wanted to resign and pursue the new career opportunity but was concerned that this may be in breach of the restrictive covenants and put him at risk of being sued.

I reviewed his employment contract with the restrictive covenants and spoke with him about his specific concerns.

The Outcome

I produced a detailed report on the enforceability of the restrictive covenants in his contract. Although I concluded the restrictive covenants were more likely than not to be enforceable I provided both detailed and practical legal advice on his options moving forward.

Although not the conclusion he had hoped for, my client was pleased that he had clear legal advice on the risks and detailed guidance on the practical steps he could take to protect his position.
