Is Gary Lineker right about a Simplified Divorce Process?

29 April 2016

There has been a lot of noise in the media about Gary Lineker’s comments following his recent divorce from his second wife. They remain good friends and the split was amicable, with both of them agreeing on the way forward without the use of Divorce Solicitors to finalise their divorce.

Gary Lineker believes that divorce should be simplified so that Solicitors can be removed from the process, but will that work for everyone?

The answer is no it won’t. A simplified divorce process will make no difference to couples who are in a bitter and acrimonious divorce.

There have been many divorce cases in the media about couples who have racked up huge legal bills trying to fight their ex-partner for what they think is fair. But in the long term, no one is a winner. Long and drawn out Court battles make an already very difficult time even worse.

Even though financial agreements and arrangements for children are not included in a divorce, these can cause as many conflicts, possibly even more than the divorce itself.

Working hard to keep things as harmonious as possible will help in every part of your divorce including helping you to avoid high legal costs.

Using a Divorce Solicitor that offers fixed fees will help you to control your divorce costs.

Divorce does not have to be complicated or costly.

At Co-op Legal Services once we have provided a written quote for the agreed work, that price will not change. There will be no nasty surprises.

We focus on helping you achieve a positive outcome that works for everyone involved. Our approach works to encourage agreement wherever possible, whatever stage you’ve reached – potentially avoiding Court proceedings and helping to minimise divorce costs.

Do Divorce Lawyers Have a Role in the Divorce Process?

Yes they do. How can you be sure that you are getting the best divorce settlement when working through your finances?

Whilst Gary Lineker has been very vocal in his view that Divorce Lawyers are only out to line their pockets, our clients tell us differently.

One client, Mrs W told us:

"I’ve been trying to write to say thank you on and off for nearly two years but I’ve never found the right words. I can’t express how grateful I am for all you did for me during that awful time – for your expertise, but also for your patience and the way you always strove to calm things down not exacerbate them and to put the long term needs of the children first. Thank you again for my children and my freedom."

Another said:

"I liked that the Solicitor was able to make feeling safe and secure achievable for me and my daughter."

And another:

"This is a service you can trust 110% to defend your interests in the best way possible."

Just these three customer comments show the key role that a Divorce Solicitor has in what is for many people, is the very worst time in their life.

No divorce is the same and the family Court takes that on board. There is not a ‘one size fits all’ approach to divorce and whilst there are guidelines and starting points, these are just that, a starting point.

Another example of how a Divorce Solicitor can really make a big difference during a divorce is by making a Clean Break Order. A Clean Break Order is a Court Order that completely severs all financial ties with your ex-spouse following a divorce. This is given when there is no need for ongoing maintenance or for any other financial tie to continue.

Without a Clean Break Order, there is the very real prospect of that an ex-spouse could come back to the Court at a later date and ask for more money.

For example, a man who divorced his wife before winning £56 million on the Lottery, had to give her an additional £2 million after not getting a Clean Break Order. She took him back to Court to take a share of his winnings. They settled out of Court. Whilst this is an extreme case, a Clean Break Order will help give you the security that you can move on from that part of your life, without future financial repercussions.

Without a Solicitor giving you specialist divorce advice, you may not fully understand the importance of such a Court order.

A cooperative approach to divorce won’t happen for everyone and it is important that the right legal advice is available to those who need it and want it.
