Rebecca Ellerbeck

Senior Family Law Solicitor, Bristol

Rebecca is a Senior Family Law solicitor at Co-op Legal Services, specialising in divorce, financial matters and children matters resulting from the breakdown of a marriage or relationship.

Rebecca qualified as a family law solicitor in 1993 and has extensive experience in the field of family law.

Rebecca acts on behalf of both applicants and respondents in financial remedy applications. She has experience in advising and representing clients from First Directions Appointments, Financial Dispute Resolution Appointments through to Final Hearing.

Rebecca advises in high net worth cases and pension sharing cases. She has expertise in dealing with cases involving partnerships, companies, farms and inherited wealth. She also undertakes smaller net worth cases which present different challenges.

Rebecca also offers advice regarding the preparation of prenuptial agreements, post nuptial agreements, cohabitation agreements and separation agreements.

Rebecca has significant experience of private law children matters acting on behalf of both mothers, fathers, grandparents and other family members. She has represented clients seeking child arrangements orders including applications in respect of whom a child should live with and spend time with. She has also represented clients on applications for prohibited steps orders, specific issue orders and applications by parents who wish to relocate with their child abroad or conversely, preventing their child from being taken out of the UK.

Rebecca also has extensive experience of dealing with domestic abuse matters representing parties in proceedings under the Family Law Act 1996 for non- molestation and occupation orders.

Rebecca recognises that a relationship breakdown often involves stress and financial upheaval and that a break up brings uncertainty about the future and concerns about what life will be like for you without your partner. She appreciates that receiving the best legal advice is extremely important and can help address those concerns and reassure parties that there is a way forward.

Rebecca is a member of Resolution, a group of family lawyers who believe that a non-confrontational approach to family law issues produces a better outcome for separating families and their children. Rebecca always makes sure that an emphasis is placed on minimising unnecessary hostility and successfully resolving matters by having a clear understanding of her client’s aims.

Rebecca has been praised for her professional and empathetic approach to clients, together with forging a good rapport with the other party or their solicitor. This enables sensible discussions to take place between the parties to limit points of dispute at an early stage and prevent unnecessary costs accumulating.

Case studies

  • Successfully represented an Applicant Mother in respect of her application to remove her child from the Jurisdiction to live permanently in Australia; at the same time ensuring that proper arrangements were put in place to ensure that substantial contact continued to take place between the child and her father.

  • Acting on behalf of an Applicant father to successfully obtain an order for contact with his daughter which was being prevented by an implacably hostile mother. This was a very complex case involving a number of Court hearings and significant evidence gathering which was carefully considered and produced at a finding of fact hearing where an order was made in the father’s favour and contact thereafter took place.

  • Acting on behalf of an Applicant wife in a very emotive case where the Respondent husband had a very short life expectancy. Due to the urgency of the situation proceedings were issued and the case progressed to a Final Hearing. The matter was finalised in less than 2 months. The wife was successful in securing an order to provide her with future financial security.

  • Acting on behalf of an Applicant wife with a severe disability in an application for a financial remedy order. Successfully securing a pension sharing order against the Respondent husband’s pension with a provision for ongoing spousal maintenance.

  • Acting on behalf of a Respondent husband. Successfully challenging an application for a financial remedy order made by the Applicant wife. The wife’s claims were defeated on the basis that she had not provided full and frank disclosure of her financial position or her intention to remarry.

  • Successfully representing a client in obtaining an urgent non molestation and occupation order at very short notice due to the client’s vulnerability.
