If you are married or in a civil partnership in England or Wales, the law states that your spouse or civil partner is entitled to inherit either the whole of your estate, or most of your estate if you have children; when you die.
In law, you are still considered as married or still in a civil partnership until it has legally ended. In the case of divorce this is once a decree absolute have been issued or, in respect of a civil partnership, once a final order for dissolution has been given by the Court.
If you were to die before the final order (Decree Absolute) or Civil Partnership Dissolution is issued then:
- Any existing Will which benefits your spouse or civil partner continues to be in force; or
- If you die without a Will in place, then your spouse or civil partner continues to be the main beneficiary from your estate under the law, called the Rules of Intestacy.
